
Legal Alliance Has Offered to Its Clients the New Models of Marketing Interaction with Pharmacy Chains
Legal Alliance Company has developed models of effective interaction in the sphere of pharmacy chain marketing based on the recommendations provided by the Anti-Monopoly Committee of Ukraine (hereinafter - "AMCU").
Each of the models designed by the Legal Alliance takes into account the relevant practices of the AMCU as well as peculiarities of the Ukrainian pharmaceutical market's functioning.
The associates with the Legal Alliance Company have also prepared full package of documents to accompany each model (i.e. standard services contracts along with necessary supplements and addenda, standard internal reports etc) for the purposes of these models' practical implementation.
By way of reminder, in March 2015 the AMCU issued its mandatory recommendations for pharmacy chains and medicine suppliers in view of putting an end to activities which may potentially lead to infringement of legislative requirements on protection of economic competition in the retail market for medicines.
In particular, the AMCU has recommended the following:
- to review the terms of the contracts for provision of marketing services which may lead to establishing economically unjustified prices for medicines by way of excluding from such contracts the services which are directly associated to the main activity of pharmacy chains, i.e. retail trade and to fix a justified marketing services fee based on the actual expenses incurred;
- to refrain from imposition of extra marketing services.
As of today, many pharmaceutical companies represented in Ukraine have already reconsidered their concepts of building up contractual relations with pharmacy chains in the sphere of marketing.
