Court rendered $2.4 million judgment in favor of client
The case is related to a commission's complex agreement pursuant to which the commissioner concluded a foreign economic contract.
In order to protect the interests of the client, the manufacturing company, it was decided to sue the court for avoidance of the agreement and the recovery of funds from the commissioner for the actual delivered goods.
The commissioner, i.e. the defendant, first decided to abide the legal position on the absence of evidence in the case file confirming its receipt of funds for the client's goods and the denial of all merits of case.
The attorneys-at-law have developed a strategy to protect the client, due to which the defendant was forced to actively participate in the case, otherwise the concept of negative evidence could be applied.
Our team has also taken all possible steps to gather evidence in the case, including ensuring that it is subpoenaed at our initiative.
This perseverance has yielded results, as it has been turned up evidence of the bank's deregulation of foreign exchange transactions, that is, proved one of the client's key arguments, namely the receipt of funds by the opponent.
It is also interesting that to divert the court's attention from the subject matter in dispute, the defendant tried to bring the dispute to the quality control of goods, as well as the presence of unsatisfied complaints. However, the attorneys-at-law underscored that the dissatisfaction of all the complaints was due to the commissioner's wrongful omission, while the stated claims do not concern the goods whose improper quality the commissioner tried to prove.
Thus, the team of Legal Alliance Law Firm helped the client receive funds for the delivered goods worth $2.4 million.
