
Next lawmaker`s step to minimize negative effects of the quarantine
On March 30, 2020, the Parliament of Ukraine adopted Draft Law No.3275 to provide additional social and economic guarantees in connection with the spread of coronavirus infection (COVID-2019).
This law amends labor, procedural, tax and other legislation.
1. Introduction of flexible work hours and remote (homebased) work
Flexible work hours are allowed provided the number of working hours remains the same and cannot affect regulation, payment and scope of labor rights of employees.
Flexible hours may include:
- Fixed time when employee is present at his/her working place;
- Variable hours, when employee makes a decision about working periods;
- Break to rest and eat.
In case of remote (homebased) work, employees have right to decide on how they distribute their working hours. As a general rule, such modes of work are agreed upon employee and employer for a definite or indefinite term at any time by signing an agreement or annex to an agreement. However, for the time of quarantine or other threats the condition for remote (homebased) work and flexible hours may be set out in employer`s order without signing agreement about remote (homebased) work.

2. During the quarantine shutting down salary payment procedure changes
Shutting down time during the quarantine that is established by the Cabinet of Ministers of Ukraine is paid for in the amount of at least two thirds of employee`s rate (fixed salary).
3. Changes in procedural terms and terms of limitation
The law stipulates extending terms of procedural terms for select actions in courts during the quarantine, for instance change of claim, submitting evidence and rehearing court decisions. However, the terms for legal proceeding are extended as well, which may negatively affect the time for protection of open cases and their reopening, in particular, when the possibility to execute court decision depends on how fast the case is processed.
Similarly, limitation period is extended fin the framework of civil, commercial; labor and family legislation for the time of quarantine established by the Cabinet of Ministers.
4. Financial bonuses to doctors that participate in COVID-19 response measures
For the period of coronavirus infection (COVID-19) response measures financial bonuses in the amount of 300 percent of salary are provided to those healthcare and other specialists that directly participate in such measures among its patients.
5. Suspension of consideration appeals by the ta service
For the period until May 31, 2020, terms of consderation of appeals that have not been considered by March 18, 2020, with regard to administrative appeals procedure are suspended.
6. Income limits for people to which simplified taxation scheme is applied are raised.
The following limits will be applied for entities that use simplified taxation procedure:
- 1 group - 1 000 000 UAH
- 2 group - 5 000 000 UAH
- 3 group - 7 000 000 UAH
Moreover, the Law introduces social protection guarantees to people that lost jobs due to the quarantine.
