
Lawyers of Legal Alliance successfully defended rights of Tetyana Dumenko in court
Yesterday on July 18, 2019, the trial in the case of Tetyana Dumenko, director of the State Expert Center of the Ministry of Health of Ukraine, finished successfully. The interests during the trial were represented by the attorney-at-law of Legal Alliance JSC – Taras Bespalyy. The judge of the Pechersk District Court Galina Matiychuk refused the State Bureau of Investigation to remove Mrs. Tetyana from the director’s post of the State Expert Center of the Ministry of Health of Ukraine.
“The main arguments of the prosecution were the followings: staying on the post in future Tetyana Dumenko will be able to destroy documents, exert pressure against witnesses, refuse to testify in the case. At the same time, as Mrs. Tetyana’s defender, I brought the judge’s attention to the fact, that the court was not provided with any evidence regarding risks noting by the Prosecutor General’s Office of Ukraine. The version of the investigation is generally based on the assumption and the evidence obtained in another criminal proceeding altogether. Moreover, during interrogation Uliana Suprun, Acting Minister of Health of Ukraine as a witness, reported that the Ministry of Health of Ukraine is aware of the rental situation, considers Mrs. Dumenko’s actions to be correct, does not see any violations on the hand of the the State Expert Center’s leadership, and categorically objects to dismissal of Tetyana Dumenko from her post," commented Taras Bezpalyy, associate partner, attorney-at-law at Legal Alliance Company”.
Now we are awaiting the full text of the decision of the investigating judge in order to understand how it is reasoned. We are also awaiting the consideration of the appeal on the hand of the Prosecutor General’s Office of Ukraine.
It should be noted, that on July 16 this year, the Quick Response Team (QRT) officers came to the State Expert Center’s premises, accompanied by Security Service of Ukraine officers, who informed Mrs. Tetyana Dumenko about the suspicion of committing a crime under Part 2 of Art. 367 of the Criminal Code of Ukraine (official negligence, entailing grave consequences). The essence of the suspicion has been reduced to the fact that the State Expert Center has rented premises for workers for a long time. Later the tenant began to demand a sharp increase in rent with a subscription, which was impossible for the State Expert Center. In this regard, Tetyana Dumenko decided to terminate these contractual relations. Subsequently, on the basis of documents having signs of forgery, the tenant charged the cost of rent, penalties from the State Expert Center. According to the Quick Response Team (QRT) and the Prosecutor General’s Office of Ukraine, Tetyana Dumenko committed official negligence in the fact: there were the fine, the court fee, and the executive fee charged from the State Expert Center by court decisions.
