Illegal inspections of the State Labor Service can end soon
Starting from May 2017 the State Labor Service of Ukraine has been authorized based on Resolution of the Cabinet of Ministers of Ukraine No. 295 as of April 26th, 2017 to carry inspection visits and non-visiting inspections which violated the procedure approved by the Law of Ukraine “On Fundamental Principles of State Monitoring (Control) in Commercial Sector”. Due to this state inspectors could abuse powers granted to them by the abovementioned resolution. As a result employers were constantly subjected to extraordinary inspections by the State Labor Service and had to pay big fines for even minor violations.
On May 14th, 2019 6th Administrative Court of Appeal by its decision invalidated the mentioned Resolution and abolished it.
The decision becomes effective upon its delivery. From that moment the State Service can carry inspections only in the manner prescribed by law.
However, the Cabinet of Ministers of Ukraine or State Labor Service are likely to appeal the decision. In this case enforcement of the decision on abolition can be suspended.
