Andrii Gorbatenko Spoke as an Expert at III Ukrainian Antitrust Forum

On May 31st, 2017 Andrii Gorbatenko, associated partner at Legal Alliance Company and head of Antitrust and Competition Law practice, spoke as an expert at a panel discussion of III Ukrainian Antitrust Forum devoted to economic analysis in competition protection cases. The event was organized by Yurydychna Praktyka publishing house with the support of the Antimonopoly Committee of Ukraine.

About 160 experts in the area of antitrust and competition law representing both legal companies and general businesses attended the Forum.

The discussion concerned the role of economic analysis during antimonopoly investigations, economic examination in cases involving the Antimonopoly Committee of Ukraine, foreign experience in economic analysis, information exchange issues, economic analysis of marketing bonuses, use of elements of economic analysis in the consideration of disputes with the Committee, as well as practical experience of economic arguments in cases involving the Committee.

During the discussion, Andrii Gorbatenko commented on the use of elements of economic analysis in the consideration of disputes with the Antimonopoly Committee of Ukraine and stressed: "Economic analysis is an important tool for verifying activities for compliance with the requirements of legislation in the area of economic competition protection. However, in the process of dealing with concerted actions in the pharmaceutical market we have to deal with approaches of the Antimonopoly Committee of Ukraine used to assess economic phenomena that are significantly different from market approaches. In particular, the approaches employed by the Committee to determine market commodity boundaries tend to narrow the market significantly".
