In 2017, Ukraine set foot on the path of judicial reform. Adoption of new codes of procedure became one of its stages. New approach to the judicial process has dramatically changed case pleading procedure in courts, collection of evidence and conduct tactics of parties and judges. It has opened up new opportunities and put new tasks before participants and judges.

At the webinar, we will consider some practical aspects of access to the judicial system, the procedure for court decision appealing and case pleading in courts.

Since courts still continue to apply practice of the European Court of Human Rights, and the Supreme Court is considering cases being guided by the principle of rule of law rather than rule of legislation, at the webinar we will bring up some judgements of the Supreme Court which can be relevant for a commercial entity in its activities.

In particular, we will consider the following issues:

  • claims of a creditor secured with collateral do not depend on the value of property specified in the agreement;
  • subject of the dispute;
  • legal and illegal use of somebody else’s money and beginning for imposition of sanctions;
  • invalidation of a deal conducted by an executive body of a legal entity beyond its authority;
  • will of an employee as a ground for labour agreement termination;
  • choosing a method of judicial protection of intellectual property rights to a medicine.
