Let us remind you that on June 30, 2017, the draft AMCU order "On Approving Standard Requirements on Vertical Coordinated Actions of Economic Entities Regarding the Supply and Use of Goods" has been posted on the website of the Antimonopoly Committee of Ukraine for public discussion.

Typical requirements is one of the most anticipated documents, since its task is to resolve the disputable issues related to violations of competition legislation in the framework of vertical concerted actions in details.

The Typical requirements are of particular interest for the pharmaceutical market, since both cases completed by AMCU and ongoing investigations refer to vertical concerted actions, in particular, in the form of conclusion of distribution contracts.

The concept of a safe harbor that is embedded in a draft of the Model Requirements may not be entirely safe for the pharmaceutical market, since taking into account the structure of the distribution market and AMCU approaches to determining commodity boundaries of medicinal products markets, the adoption of the Draft Model Requirements will result in the fact that almost all distribution contracts will not enter a safe harbor and will be subject to AMCU approval.
