Successful settlement of a dispute through the conclusion of a settlement agreement

In 2017, one of Legal Alliance clients became a defendant in a lawsuit on the legitimacy of the registration of two of his trademarks on medicines. For drug manufacturers such claims always have a double price, since the cancellation of the trademark registration and prohibition to use it have additional consequence, such as administrative procedures, changes in packaging and loss of sales that is experienced also by consumers.
The peculiarity of the case support was that there was no evidence from the client. Therefore, the lawyers of Legal Alliance Company had to conduct a thorough investigation to establish evidence and develop a legal position.
As a result, the evidence collected not only allowed us to take a firm legal position, but also opened the prospect for a recourse to court with a countersuit. This became an additional argument for the proposal to open negotiations and conclude a settlement agreement.
