Legal Alliance Company conducted an Internet conference on public procurement

On July 23 of this year at 10.00 am at the law portal Pravotoday an Internet Conference «Public procurement: analysis of key changes in the procedure for their implementation» was held by Yana Kartseva, the lawyer with Legal Alliance Law Company. Very soon a new law "On public procurement", which was adopted in general on June 01, 2010 and entered into force on June 30, 2010 will be put into effect, replacing the rules of procurement of goods, works and services for public costs, approved by the Cabinet of Ministers on October 17, 2008 № 921.

The Law considerably specified the order and slightly modified the procedure for public procurement in Ukraine.

Adoption of the Law in general is a positive step for Ukraine, however, the law leaves open a number of issues, considering which it is impossible to evaluate chances for stabilizing the situation in public procurement and establishment of a fair and effective system for regulating procurement procedures in Ukraine.

During the Internet conference Ms. Kartseva replied to questions concerning the key changes proposed by the new Law, among which it is worth defining the following:

1. Terminology
2. Scope of application of the Law.
3. The principle of non discrimination of participants.
4. Specification of status of the Authorized Body.
5. Establishing a new procedure for procurement procedures appealing and body of appeal.
6. Procedure for publishing of information, the amount of information, mentioning in the procurement documentation.
7. Main types of procurement procedures.
8. Procedure of competitive bidding.
9. Provisions on procurement contracts.
10. Terms in different procedures for public procurement, etc.
