March 22, 2010 the Legal Alliance Company held various events having as their subject “Medications advertising. How to determine the possible limits. New practice?”.
At 11.00 the Internet conference was arranged where Legal Alliance Company Senior Partner Ilia Kostin and Partner Aleksey Bezhevets gave on-line answers to the questions posed by Liga. Zakon Portal users.
At 16.00 all who wished to do so might attend the workshop having the same title held in Office of Legal Alliance Company and deliver their questions to be answered by company partners.
Topicality of the above events was substantiated by the fact that currently it is observed a change in the application of Article 21 of the Law of Ukraine "On advertising" and the Law of Ukraine "On protection from unfair competition”. Previously, marketing and advertising professionals did not pay enough attention to the statutory requirements, but recent application by the Antimonopoly Committee of Ukraine of the sanctions stipulated in the Law of Ukraine "On protection from unfair competition” due to breach of the provisions of the Law of Ukraine "On advertising" bring about some changes to the earlier existing situation.
It is evident that substance prevails over form. Linguistic explorations that were capable of protecting an advertising company from claims put forward by a supervising authority are no longer relevant for investigations carried out by the Antimonopoly Committee of Ukraine. The focus is put on the perception of advertising slogans by consumers.
Some time ago, the sanctions imposed by the Antimonopoly Committee of Ukraine for similar infringements was quite modest (minimum amount), presently the amount of penalties is significantly larger.
