Legal Alliance Company summarized its expertise in the area of pharmaceutical law

Legal Alliance has summarized its expertise of dealing with some topical issues of the pharmaceutical law in 2009. It is presented in the form of a booklet "PHARMABUSINESS: topical issues. Advertising, intellectual property and prices".

Legal Alliance Partner Aleksey Bezhevets said: "The principal objective of this booklet is to assist pharmaceutical companies in Ukraine to resolve their day-to-day operational issues. Summary of our expertise of how to deal with the assignment brought by our Clients enabled us to determine the topical issues such as pharmaceuticals advertising, intellectual property and regulation of prices for pharmaceuticals".

The booklet provides legally based and practically tested approaches to resolution of some issues related to the above areas. The section dealing with the pharmaceuticals advertising gives answers the questions on distribution of information about medical preparations at press conferences, in specialized booklets, among doctors and patients, the correct way of placing the information about prescribed drugs on web-site, and the risks of use of the superlative degrees of comparison in pharmaceuticals advertising.

The section dealing with the protection of intellectual property rights presents the benefits of pharmaceuticals' patent protection, gives analysis of effect of international patents in the Ukrainian territory, and the position with respect to the protection of rights for active agent of a medication.

Finally, the section "Regulation of prices for pharmaceuticals" gives answers the questions about the mechanism of price regulation, criteria applied by domestic and foreign manufacturers, approach to determining the price for an imported product, average rate of the interbank market, date of sale of medical preparations, effect of manufacturers' discounts on establishment of the price for imported product, procedure for formation of purchase and retail price, responsibility incurred as a result of breach of price discipline, and list of authorities supervising compliance with the price discipline.

The booklet "PHARMABUSINESS: topical issues. Advertising, intellectual property and prices" will become one of the New Year presents prepared by the Legal Alliance Company for the actors at the pharmaceutical market.
