Dmytro Aleshko, Senior Partner of Legal Alliance spoke at Pharmacy-2009: Crisis Lessons Conference
On December 2, 2009, the All-Ukrainian Pharmaceutical Conference titled Pharmacy-2009: Crisis Lessons was held, where leading experts of the industry tried to find answers to topical questions for all actors of the pharmacy market in 2009, such issues will be of importance also in the coming year.
The Event was held under the slogan "Ukraine-2010: government regulations vs. pharmaeconomy - legal regulation of pharmaceutical activities or Ukraine without medications" and was attended by 170 representatives of the market, such as manufacturers, distributors and pharmacies' employees.
Dmytro Aleshko, Senior Partner, LC "Legal Alliance", made presentation "Legal analysis of medication market regulation: state procurements and price monitoring", where he gave a description of the situation existing in Ukraine and review of foreign practice of the regulation of process for medical preparations. At the end of his presentation Mr. Aleshko presented his view of how the national model of medication market regulation can be modernized through:
- Resistance to adoption of the Law of Ukraine "On moratorium to raise of prices and tariffs for medical preparations and products used for medical treatment";
- Establishment of monitoring and registration of prices only for procurement of medical preparations and products used for medical treatment with government funds;
- Single out government procurement in separate body which enables the Ministry of Health Protection to modernize the industry;
- Cancellation of direct imposition of markup caps as a non-market tool used to regulate the market;
- Introduction of mandatory medical insurance system stipulating for regulation of prices of the prescribed preparations through cap for prices used for insurance compensations.
