The EuroDebates of the Health Care Committee of the European Business Association took place on October 29.
The event participants included businessmen, public officers, representatives of non-governmental organizations and mass media. Legal Alliance Law Company, which is actively involved in the pharmaceutical law practice, was represented by its Senior Lawyer, Andriy Gorbatenko.
The situation related to adoption of the Law on Moratorium on Price Increase on Medical Drugs and Medical Products by the Verkhovna Rada of Ukraine, which provides for fixation of prices on medical drugs at the level of July 01, 2008, was put in the agenda of the debates.
According to Mr. Pasichnik Mykhaylo Frantsovych, Chairman of the Professional Pharmaceutical Association, first of all, the introduction of moratorium will hit drug-stores and lead to withdrawal of most of them from the market.
Andriy Gorbatenko laid emphasis on this Draft Law conflict with the Constitution of Ukraine with regard to the authorities of the Verkhovna Rada of Ukraine in the field of price regulation and drew attention to the obligation of the state to cover damages arising in consequence of underpricing as provided for in the Economic Code of Ukraine.
The special emphasis was laid on the problem of reimbursement to suppliers of medical drugs and medical products. Within the framework of discussion, the participants analyzed the consequences of the Law coming into effect and came to the conclusion on their potential hazard not only to the pharmaceutical entities, but also to the whole system of population epidemiological security in the country.
