Legal Alliance Law Company became a legal adviser to Diagnostic Systems — Ukraine Ltd.

Diagnostic Systems — Ukraine Ltd. is a subsidiary company of the largest manufacturer of immunoassay systems for infectious diseases detection as well as reagent kits for bacteria identification in Russia.

Successful implementation of this project has become a dramatic example of how a foreign manufacturer of medical products can protect its business against unpredictable changes in the Ukrainian legislation.

Last December, the Supreme Council of Ukraine adopted a law, according to which purchase of goods, works and services using public funds has become possible only from domestic manufacturers of such goods, works and services, except for the goods that are not manufactured in Ukraine.

In other words, any tender bid of the participants, who offer foreign-made goods, was dismissed in case of the Ukrainian analogue availability. A lot of foreign manufacturers, which entered the Ukrainian market and participated in the public tenders, particularly in the field of medical products, on a regular basis, were divested of this right. Consequently, a foreign manufacturer offering higher quality and, in many cases, lower prices, appeared at a loose end.

The optimal solution of the assigned task was to set a foreign manufacturer of medical products to the rank of national manufacturer.

The Company's lawyers have found a lawful way out of the situation, performed a legal due diligence, on the basis of which the scheme of implementation of the project of registration of medical products of the national manufacturer and the project documents were developed. Thereto, they assisted in the process of registration.
